Terms and conditions of use
Article 1 - Purpose
These terms and conditions of use cancel and replace all prior terms and conditions and apply to any order placed on the website www.petitevoile.fr, with regard to the products presented on the webiste by the company THE FRENCH ROOM SAS, limited company registered at the "registre du commerce et des sociétés de Cusset" under the number 811 760 461 00012 (VAT number FR74 811760461), with a capital of 10 000€ and whose head office is located at 9 Chemnin de la Varenne du Léry, 03700 BELLERIVE SUR ALLIER, FRANCE.
Unless otherwise required by law, the terms and conditions of use applicable to the relation between THE FRENCH ROOM and the Customer are those in force the day on which the order is placed. They apply to the exclusion of any other condition.
Article 2 - Price
The price of our products are given in euros and all taxes included (VAT and other taxes applicable the day the order os placed), unless otherwise specified and except shipping costs.
When a customer places an order from outside metropolitan France, they are considered an importer of the product or products in question. VAT, Customs duties or local taxes, import duties or local taxes may be payable. These taxes are not the responsibility of the company THE FRENCH ROOM SAS. They are to be paid by the customer, who is entirely responsible as regards both declarations and payments to the competent authorities and bodies in the country concerned. We advise you to inquire about these aspects with your local authorities.
All orders, regardless of their origin, are payable in euros.
The prices are subject to change at any time, but the Products shall be invoiced on the basis of the rate in force at the time of recording the order and subject to availability.
The products remain the property of THE FRENCH ROOM SAS until full payment of the price.
Please not that as soon as the new owner takes physical possession of the ordered products, the risk of loss of and damage to the products will be borne by the Purchaser.
Article 3 - Orders
You can place an order online in our webshop www.petitevoile.fr
Contractual information is presented in English and will be subject to confirmation when validating the order.
The company THE FRENCH ROOM SAS reserves the right not to record a payment or not to confirm an order for whatever reason, and more particularly in the event of supply problems, or in the event of difficulties concerning the order.
Orders cannot be cancelled after being subject to firm order validated by us.
Article 4 - Validation of your order
Any purchase order on the website www.petitevoile.fr constitutes your agreement, without restrictions or reservations, to the herein Terms and Conditions of use.
The collected datas in their entirety and the stored confirmation consist of a proof of the business transaction.
You acknowledge to have fully understood these Terms and Conditions of use.

The confirmation of order is worth a signature and implies the agreement to the business transaction made.
A summary of your order information will be sent to you in PDF format via the email address of your order confirmation.
Article 5 - Payment
The act of validating the order implies the obligation for you to pay the indicated price.
The payment of your order is made by credit or debit card thanks to the PayPal secure system.
Article 6 - Withdrawal
In accordance with article L.121-21 of the French Consumer Code, the customer has a period of 14 days from the date of receipt of the parcel, to exercise his right of withdrawal without any reasons or incurring penalties.
The products must be returned in perfect condition for resale in their original state (packaging, accessories, instructions ...).
In this context, you will be responsible for it. Any damage suffered by the product on this occasion might nullify the right of withdrawal.
The return costs are at your expense
In case of exercise of right of withdrawal, the company THE FRENCH ROOM agrees to reimburse the customer the money paid, within 14 days from the date of notification of your request and on return of the products, through the same means of payment used for the order. To exercise your right of withdrawal, you need to inform us through a formal declaration of your decision to cancel this contract (for example via mail or email).

Article 7- Availability
The products we proposed are valid for as long as they are visible on the site www.petitevoile.fr, subject to the number of items in stock.
For products not stored in our warehouses, our offers are valid subject to availability from our suppliers.
If unavailability of product after placing your order, we will notify you by mail. Your order will automatically be cancelled and no debit will be made.
Article 8 - Delivery
The products will be sent to the delivery address indicated in the order form, within the term indicated on the validation page of the order.
In the event of late delivery, an email will inform you of a potential consequence on the delivery deadline you were indicated.
In accordance with applicable law, in the event of late delivery, you have the right to cancel your order under the conditions and according to the procedures defined by article L 138-3 of the French Consumer Code.
In case of delivery with carrier, the company THE FRENCH ROOM SAS cannot be responsible for late delivery due solely to the unavailability of the client after several proposals for appointment by the carrier.
Article 9 - Guarantee
All our products are covered by a legal warranty of conformity and the guarantee of hidden defects as stipulated by the articles 1641 of the French Civil Code. In case of non-conformity of a product sold, it should be returned to us for exchange or refund.
All claims, requests for exchange or reimbursement must be made by email within 14 days on delivery to the following address: je.weber@thefrenchroom.fr. Products must be returned in the state in which you received them with all elements (accessories, packaging, instructions...). The shipping costs will be reimbursed on the basis of the prices billed and the return shipping charges will also be reimbursed upon presentation of the receipts with our previous agreement.
The stipulations of this article do not prevent you from benefiting from the withdrawal right defined in article 6.
Article 10 - Responsability
The products offered are in compliance with the French legislation in force. THE FRENCH ROOM SAS cannot be held responsible in case of non-respect of the legislation of the country where products are delivered.
It is your responsibility to check with local authorities all regulations regarding import and usage of products or service you plan to order.
Furthermore, the company THE FRENCH ROOM SAS cannot be held responsible for damage caused by improper use of the products ordered.
Finally, the company THE FRENCH ROOM SAS cannot be held responsible for any inconvenience or damage inherent to Internet use, in particular service failure,external intrusion, the presence of a computer virus.
Article 11 - Applicable law in the event of dispute
The language of this contract is English. The present terms and conditions are subject to French law. Any dispute that may arise regarding our goods, regardless of its nature or basis, will be in deed or in law, referred exclusively to the Courts of Cusset Vichy.
Article 12 - Propriété intellectuelle
All the elements of the website www.petitevoile.fr are and remain the intellectual and exclusive property of THE FRENCH ROOM SAS. Nobody is allowed to reproduce, use, rebroadcast, or use for any reason whatsoever, even partially, elements of the site whether software, visual or audio. Any simple or hypertext link is strictly forbidden without express written agreement from the company THE FRENCH ROOM SAS.
Article 13 - Personal Data
The company THE FRENCH ROOM SAS reserves the right to collect your personal information and data. This information and data are necessary for processing your order and for improving the services and information we provide.
It may be transferred to companies contributing to these relations such as those in charge
of carrying out the services and orders for their management, execution, processing and payment.
This information and data is stored for the purpose of security and in order to fulfill legal obligations.
In accordance with the French law of January 6th 1978, you have at any time, a right of access,rectification and opposition to all of your personal data, directly on the website.
Article 14 - Proof of Archival Storage
The company THE FRENCH ROOM SAS will archive the orders forms and invoices on a reliable, durable medium which provides a true copy in compliance with the provision of Article 1348 or the French Civile Code.
The computerized databases of the company THE FRENCH ROOM SAS shall be deemed by the parties to be proof of the communications, orders, payments and transactions occurring between them.
